Terms and Conditions for DEDAL

Distributed Ecosystem for Drone Analytics in Life-sciences

1. Definitions

1.1. Agreement: The legally binding agreement between JIC and the Client comprising these Terms and Conditions.

1.2. Client: The individual or entity using the DEDAL image analysis and hosting services provided by JIC.

1.3. Images: Any visual content uploaded by the Client to the DEDAL platform for analysis and temporary hosting.

1.4. Hosting Period: The maximum duration of 7 days during which the Images will be hosted on the DEDAL platform.

1.5. DEDAL: The cloud-based platform for drone data analysis hosted by the John Innes Centre (JIC), aimed at supporting the UK crop genetics community.

2. Scope of Services

2.1. JIC provides drone image analysis services, including processing raw drone data to generate orthomosaics and plant health indices.

2.2. Processed images will be temporarily hosted for a maximum of 7 days.

2.3. All Images will be automatically deleted after the Hosting Period.

2.4. JIC reserves the right to remove any Images that violate these Terms.

2.5. Fair Usage Policy: JIC may restrict or suspend accounts engaging in excessive or disruptive usage.

3. Client Obligations

3.1. The Client warrants they own or have necessary rights to upload the Images.

3.2. The Client agrees to indemnify JIC against any claims resulting from improper Image use.

4. Intellectual Property Rights

4.1. The Client retains ownership of uploaded Images.

4.2. JIC does not claim rights over Images.

4.3. The Client is responsible for ensuring uploaded Images do not contain unlawful content.

5. Data Protection and Privacy

5.1. JIC is the data controller for personal data provided.

5.2. Personal data collected: Name and email address.

5.3. Data is used for platform access and communication.

5.4. Personal data is retained during platform use and deleted upon request.

5.5. Users may opt out or request data deletion via the opt-out page.

6. Limitation of Liability

6.1. JIC is not liable for any loss or damage to Images, except in cases of gross negligence.

6.2. JIC’s liability is limited to £5,000.

7. Termination

7.1. JIC may terminate services if the Client breaches these Terms.

7.2. Upon termination, all Images will be deleted.

8. Force Majeure

8.1. JIC is not liable for service failures due to events beyond its control (e.g., natural disasters).

9. Governing Law and Dispute Resolution

9.1. These Terms are governed by the laws of England and Wales.

9.2. Disputes will be resolved through negotiation, mediation, or arbitration.

10. Entire Agreement

10.1. These Terms constitute the entire agreement between the parties.

11. Amendments

11.1. JIC may amend these Terms at any time. Continued use constitutes acceptance.

12. DEDAL-Lab Service

12.1. DEDAL-Lab provides a hosted Docker container service for analysing orthomosaic images.

12.2. The service is available for up to 10 hours, after which all data is deleted.

12.3. Clients must download data before session expiration.

12.4. JIC is not liable for data loss from expired sessions.
